Economic DamagesThe measure of loss in civil litigation is often the economic loss, i.e., the actual erosion in economic position that is traceable to a specific cause of action, net of offsetting mitigation. Our services include analysis of the business, its markets, market power and costs together with a parallel analysis of the legal causes of action for which economic damages are claimed. With an understanding of the business model employed and the events outlined in the complaint, we compile a baseline of operations under a scenario in which the causes of action are absent, and compare that to operations which actually occurred. Considering mitigation opportunities, whether exploited or not, our report shows the bottom line net result of the events that are the subject of the civil action.
